SelfiPay is an application (hereinafter referred to as “SelfiPay“, “the application”, “We” or “Us”), operated by CRIOPAY AD, a joint stock company registered in the territory of the Republic of Bulgaria with UIC 207839409 and an address at Plovdiv (4003), 14 "Neofit Rilski" St.
SelfiPay aims to revolutionize the way people make payments by using facial recognition technology for fast, secure, and contactless transactions. Our goal is to eliminate the need for physical cards, cash, or phones, providing a seamless shopping experience while ensuring top-tier security with encryption and tokenization. We are committed to driving the future of payments by making everyday transactions smarter, safer, and more convenient for everyone.
These Terms and Conditions ("Terms") govern your access and use of SelfiPay's services, software, applications, and related technologies ("Services"). By accessing or using our Services, you agree to comply with these Terms.By using SelfiPay, you confirm that you are 18 years or older, or if under 18, have obtained parental consent. Your continued use of SelfiPay constitutes your acceptance of these Terms and any future updates.

You represent and warrant that you are an individual of legal age to form a binding agreement. If you are under the age of 16, please do not use the Service of SelfiPay.You will only use the Service for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If the use of the Service is prohibited by applicable laws in the jurisdiction in which you are located, it is recommended that they should not be used.We shall not be liable for any use of the Service by you that is in violation of the law. Your continued use of SelfiPay after any changes to these terms signifies your acceptance of the updated terms.
We are always trying to improve our Service, so they may change over time. We may suspend or discontinue any part of the Service, or we may introduce new features or impose limits on certain features, or restrict access to parts or all of the Service. We will give you notice when we make a material change to the Service that would adversely affect you. We reserve the right to remove any content from the Service at any time, for any reason, in our sole discretion, and without notice.

Following the initial facial scan, the user can:
You shall notify us immediately of any change to your personal data. You can modify your personal data in the application. If you change your e-mail address or telephone number, a new confirmation will be required.
Remember that all your personal data provided to us should be accurate, true, up-to-date and not misleading. The use of information or documents of other individuals, as well as the use of forged, counterfeited, altered, falsified or untrue documents, is strictly prohibited.
An initial facial scan is required to create an account. This is necessary in order to prevent the use of your payment card by another person. Thereby, this card is linked to your biometric pattern and no other person will be able to register it using a different facial image. This facial scan is assigned to Your SelfiPay account in the form of an IT record. This IT record is a digital representation of Your facial readings, captured using SelfiPay technology, and is stored by Us in an encrypted format.
You shall add Your payment card details during registration or after.
You can register or delete your payment card details utilizing the dedicated functionality provided within the application.
In order to register Your payment card, You shall provide the following information: the number of the payment card, the name of the holder of the payment card, its CVC2/CVV2 code, and its expiry date.
Please note that in relation to the use of SelfiPay, We will not request any further completion of Your payment card details other than during the registration process in the application.
You have the option to remove a registered payment card from SelfiPay at any time using the application’s dedicated functionality. However, removing a payment card disables the ability to make payments with that specific card.
You may only register a payment card if You are its rightful holder and have the necessary rights of use for that particular payment card. The following actions are strictly prohibited during the payment card registration process:
If We have any doubt or actual knowledge that any of the above circumstances occur after the payment card has been registered, We will proceed to remove this payment card from SelfiPay.
In order to make a payment using our Services, You first need to create an account in the application. Once the facial scan has been completed and the payment card details have been entered into the application, You have everything you need to make a payment.
For this purpose, a “Biometric POS” Terminal will be placed in the stores where you can make purchases, through which you can make a payment just by scanning your face.
Upon authorizing a payment by performing a facial scan, the registered card is used to initiate a payment order.
As part of SelfiPay, We neither provide a payment service nor mediate in the transfer of funds.
SelfiPay has no control over your balance and is not liable in the event of a declined transaction by the financial institution that issued your payment card. In such a case, please contact the latter.
To submit a payment via the “Biometric POS” Terminal, You shall have a completed facial scan and registered payment card.
To submit a payment using “Biometric POS” Terminals, you should follow these steps:
The completion of the activities specified in this section of the Terms and Conditions constitutes the submission of payment via the “Biometric POS” Terminal.
The use of SelfiPay should only be for purposes and in a manner consistent with the law, good practices, and the Terms and Conditions. SelfiPay is intended for non-business, non- professional use only.
We do not charge any fees for using the application.
The application provides You with the ability to view Your history of payment submissions.
Except and solely to the extent such a restriction is impermissible under applicable law, you may not: (a) reproduce, distribute, publicly display, publicly perform, or create derivative works of the Service; (b) make modifications to the Service; or (c) interfere with or circumvent any feature of the Service, including any security or access control mechanism. If you are prohibited under applicable law from using the Service, then you may not use it.
By using the Service, You agree not to:
SelfiPay applies the strictest measures to ensure the safety of its users’ data from breaches and hacker attacks, however if you authorize or allow others to use your supported mobile device (for example, by providing your passcode to a third party or allowing a third party to add their biometric data to use SelfiPay, or otherwise providing any of your credentials to a third party), the person may be able to make payments, impersonate your identity, or make other transactions with your provided credentials in SelfiPay. In such event, you will be responsible for all payments, access, verifications, and transactions made by that person.

Children’s Online Privacy Protection Act
The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 16 years of age. We do not knowingly collect or solicit personally identifiable information from children under 16 years of age; if you are a child under 16 years of age, please do not attempt to register for or otherwise use the Service or send us any personal information. If we learn we have collected personal information from a child under 16 years of age, we will delete that information as quickly as possible. To ensure Your security while using SelfiPay, only use the application on a mobile device that is secure, malware-free, and has updated software such as the operating system, drivers, applications, and threat protection software. Here are some safety rules to follow.
Remember, SelfiPay is for personal use only. Never allow others to use Your SelfiPay account, You cannot appoint a legal representative, or otherwise authorize a third party to use them.
You cannot re-register if You are already a registered SelfiPay user. You cannot be registered in the application by another person (e.g. legal representative or guardian).
Always protect Your SelfiPay PIN, the mobile device on which You use the application, and other credentials (including the payment card) from access by third parties. You are obliged to properly secure the mobile device on which You use the application against malicious software.
If You suspect that an unauthorized person has gained or may have gained access to Your mobile device or SelfiPay PIN (e.g. as a result of their loss, theft, or misappropriation) or that an unauthorized person has used Your mobile device or SelfiPay PIN, You should report this to Us by e-mail to support@criopay.com.
Do not share Your application, SelfiPay PIN, or other credentials with anyone. Always store Your device, SelfiPay PIN, and credentials in a way that prevents others from accessing them.
All content on SelfiPay, including text, images, trademarks, and software, is property of SelfiPay or its licensors. You may not use, copy, distribute, or exploit any part of the Services or content without our express written permission.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SELFIPAY BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY MATERIALS OR CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY SELFIPAY ENTITY HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGEEACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE
BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
If you authorize or allow others to use your supported mobile device (e.g., by providing your passcode to a third party or allowing a third party to add their biometric data to use SelfiPay, or otherwise providing any of your credentials to a third party), the person may be able to make payments, impersonate your identity, or make other transactions with your provided cards in SelfiPay. In such event, you will be responsible for all payments, access, verifications, and transactions made by that person.
Always ensure to report any loss, theft, misappropriation or unauthorized use of the payment card, or unauthorized access to the payment card in the manner prescribed by the payment card issuer. Regardless, under such circumstances, it is Your responsibility to remove the payment card from the application.
To the fullest extent permitted by law, you are responsible for your use of the Service, and you will defend and indemnify SelfiPay, its affiliates and their respective shareholders, directors, managers, members, officers, employees, consultants, and agents (together, the “SelfiPay Entities”) from and against every claim brought by a third party, and any related liability, damage, loss, and expense, including attorneys’ fees and costs, arising out of or connected with: (1) your unauthorized use of, or misuse of, the Service; (2) your violation of any portion of these Terms and Conditions, any representation, warranty, or agreement referenced in these Terms and Conditions, or any applicable law or regulation; (3) your violation of any third-party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (4) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of those claims.
You are free to end your use of the Service at any time.SelfiPay is also free to terminate (or suspend access to) your use of the Service for any reason in our discretion, including a breach of these Terms by You. SelfiPay has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
SelfiPay reserves the right to suspend or terminate your account and access to the application at any time, with or without notice, for any reason, including but not limited to, violation of these Terms and Conditions or engaging in prohibited conduct.
All disputes shall be settled by negotiation and in an amicable manner. In the event that a mutually acceptable agreement is not reached, all disputes arising out of or relating to the use of the Services shall be resolved by a Bulgarian court of competent jurisdiction under applicable Bulgarian law.
